Win a Business Makeover Worth R100,000! Competition

  1. COMPETITION
    1. This promotional competition “Win a Business Makeover worth R100,000!” (One Hundred Thousand Rand) (“Competition”) is organised and run by Zapper Marketing Southern Africa (Pty) Limited (“Zapper”) and VISA (“Visa”), jointly referred to as ‘the Promoters’.
    2. The Competition will run for a limited period, from 16 July 2023 to 31 January 2024, both dates inclusive (“the Competition Period”), and after the closing date Zapper Tap to Pay transactions will not be considered as entries to the Competition.
  2. ELIGIBILITY AND CONSENT
    1. The Competition is open for entry by all South African residents of 18 years and older with a valid South African identity document, except employees of Zapper and VISA and their advertising and/or promotion agencies, and/or their immediate families.
    2. Participants in the Competition agree that Zapper may contact them in connection with the Competition as well as with future competition or promotions.
    3. By entering the Competition, each participant agrees that, in the event that he or she wins one of the prizes, the Promoters may publish his or her name, surname and images, including photographs, on Zapper’s social media accounts and/or television without any liability to the Promoters or remuneration due to such participant, and that he or she will co-operate with any reasonable requests by the Promoters relating to post-winning publicity.
    4. By entering this Competition, all participants agree to be bound by these terms and conditions, which will be interpreted by the Promoters; the Promoters’ decision regarding any issue with the Competition will be final and binding and no correspondence will be entered into.
  3. PARTICIPATION IN THE COMPETITION
    1. This is a transaction-based Competition. Entries may only be submitted via a Tap to pay transaction. The use of false information on the Zapper app will disqualify such user from participating in the Competition.
    2. To enter and participate in this Competition, all participants are required to use the Tap to Pay feature on the Zapper Merchant App, and Zapper Merchant Lite App.
    3. Every Tap to pay transaction via the Zapper Merchant App and Zapper Merchant Lite app is an automatic entry into the Competition (for example, if a merchant conducts 500 Tap to pay transactions during the competition, they will have 500 entries into the mail draw to win the Business Makeover worth R100,000, and therefore participants can enter the Competition multiple times.
    4. Participants are permitted unlimited entries into the Competition during the Competition Period.
  4. WINNERS AND PRIZES
    1. The main prize to be won includes a business makeover valued at R100,000 comprising of business consulting, and a cash component of R50,000.
    2. A participant may only win one weekly prize during the Competition.
    3. The prizes do not cover any costs of the winners whatsoever or howsoever incurred.
    4. The prizes will not be transferable or negotiable, and no requests for cash or other alternatives will be considered.
    5. The winners will be selected by a weekly random system-generated draw, which will be overseen by an independent third party.
    6. The prize winners will be contacted via the contact details submitted by them when signing up their business with Zapper, within 48 hours of a draw having taken place.
    7. In the event that a winner is disqualified from accepting a prize in terms of the Competition rules in regard to eligibility (as set out above), or is unable to accept a prize for any reason whatsoever, a replacement winner will be drawn from the remaining qualifying participants in accordance with the same process as applicable to the draw.
    8. Zapper reserves the right:
      1. to select an alternative winner in the event that that it reasonably believes, in its sole discretion, that the drawn winner has contravened any of these terms and conditions; and
      2. to draw the winners on any alternative day should the need arise due to unforeseen circumstances.
    9. Zapper may require a winner to provide additional information as may reasonably be required to confirm the identity of the winner and to process and/or facilitate the winner’s receipt or use of the prize.
  5. INDEMNITIES AND LIMITATION
    1. No responsibility will be accepted by the Promoters for any entry that is not delivered, received or is delayed due to technical reasons or otherwise.
    2. To the fullest extent of the law, the Promoters exclude any and all representations not contained in these Terms and Conditions, and these are the sole recordal of the terms and conditions of the Competition.
    3. No participant or winner shall have any claim whatsoever against Zapper or VISA for loss or damage, whether direct, indirect, consequential or otherwise, and howsoever arising from participation in this Competition.
  6. DATA PROTECTION AND PRIVACY
    1. In connection with running this Competition, drawing the winners and awarding the prizes, the Promoters (and where necessary their associated companies and agencies) will collect and use relevant transaction data relating to the participant, and use such personal information for such purposes.
  7. GENERAL
    1. The terms and conditions of the Competition may be varied by reasonable notice at any time during the Competition Period, and such varied terms and conditions will be effective as at such date as may be determined by the Promoters. No participants shall have any recourse against Zapper or VISA as a result of the variation of the terms and conditions.
    2. Zapper and VISA reserve the right to:
      1. extend or shorten the Competition Period for technical reasons or due to unforeseen circumstances beyond its control; and/ or
      2. terminate the Competition if required to do so by any lawful authority
    3. and in such events participants shall have no recourse against Zapper or VISA whatsoever.
    4. Any decisions taken by Zapper and VISA in respect of the Competition shall be final and no correspondence will be entered into.
    5. Any term or condition applicable to this Competition that is illegal or unenforceable under any law or regulation shall be ineffective to the extent of such illegality or unenforceability without invalidating the remaining provisions.
    6. The terms and conditions of the Competition shall be governed by the laws of the Republic of South Africa.
